Terms and Conditions Acceptance of Agreement

THE TERMS AND CONDITIONS FOR LASERGIFTS®, ON BEHALF OF ITS EMPLOYEES AND REPRESENTATIVES, OF PRODUCT SALES AND SERVICE INCLUDE BUT ARE NOT LIMITED TO THOSE CONTAINED HEREIN. ANY ADDITIONAL OR DIFFERENT TERMS OR CONDITIONS IN ANY FORM DELIVERED ARE HEREBY DEEMED TO BE MATERIAL ALTERATIONS AND NOTICE OF OBJECTION TO THEM AND REJECTION OF THEM IS HEREBY GIVEN.

BY ACCEPTING DELIVERY OF THE LASERGIFTS® PRODUCTS IDENTIFED ON THE INVOICE, OR OTHER SUFFICIENT LASERGIFTS® DOCUMENTATION, CUSTOMER AGREES TO BE BOUND BY AND ACCEPTS THESE TERMS AND CONDITIONS UNLESS CUSTOMER AND SELLER HAVE BOTH AGREED TO AND SIGNED A SEPARATE AGREEMENT, IN WHICH CASE THE SEPARATE AGREEMENT WILL GOVERN.

Sufficient documentation of approval would be considered as one or several of the following: (a) apply for credit with LaserGifts®;(b) sign a contract with LaserGifts® on paper or electronically; (b) accept agreement through an oral statement; (c) pay for LaserGifts® products; (d) are in possession of LaserGifts® products; (e) offer LaserGifts® products in a retail setting.

 

Credit Process

LaserGifts® reserves the right to establish credit based on any, all or none of the following means of obtaining credit including; various credit reporting agencies, references submitted to LaserGifts® on behalf of the customer or payment history obtained through alternate resources available to LaserGifts®. LaserGifts® reserves the right to refuse credit to any customer.

 

Product Returns

Any product return to the LaserGifts® warehouse must have an RMA associated with the return. The quantity on the RMA must be exact to what was received. Any overage of product upon receipt will be destroyed or returned at the customer’s expense. Credit will not be issued on overage. Goods must be packaged in materials provided by LaserGifts® which are shipped to the customer once an RMA number has been assigned. Products returned to the warehouse that are packed incorrectly, damaged and/or shopworn will not be credited. A 10% restocking fee may be applied against the total credit based on the wholesale value of saleable goods being placed back into inventory. Credit will not be issued until all goods are received, counted and quality checked by the LaserGifts® Inventory Team.

 

Orders/Production

Freight charges are prepaid by the shipper and added to the invoice unless otherwise noted. There is a 1.5% convenience fee for non pre-paid orders. Once order acknowledgment has been sent, requests to cancel order may not be accommodated. LaserGifts® reserves the right to apply rush fees for orders requiring expedited production and shipping. These fees are $50.00 for a 24-hour rush processing, and $25.00 for a 48-hour rush processing. There will be a fee of up to $100.00 for custom painting a display. Due to the nature of our industry, there is a possibility that there will be an overage or shortage on manufactured product. Although LaserGifts® attempts to minimize these occurrences as much as possible, please be aware that a customer may receive a reduced or increased quantity of up to 10% and will be billed accordingly.

 

Product Refusals

Product returns placed back into stock will be charged a 20% restocking fee. Product refused by the customer will be charged a $15.00 shipment refusal fee, plus shipping costs, as applicable. Custom products refused will be billed at the full amount of invoice.

 

Past Due Accounts and Collections

All accounts, along with accounts that are associated by ownership or partnership, with overdue balances may be placed on account hold, restricting all new shipments, at 45 days past due. Past due invoices may be charged a finance charge of 1.5% per month, and/or a onetime late fee, on the unpaid balance or the maximum amount allowed by state. We reserve the right to apply an NSF fee for checks returned. The collections process will begin for accounts more than 90 days past due, return of product for credit will not be available. Attorney fees, finance charges, and collection costs will be added to all accounts placed for collection. LaserGifts® reserves the right to place UCC1 filings against all products shipped. Accounts that received a promotional credit or discount will have credits reversed. If the account falls into collections status the full balance of the program will be due, if credits were allowed as a buy back the product will not be returned. This affects all buy out programs, buy one get one free, buy one get one half off and discount programs, or any future programs offered.

 

Guarantee Program

Guarantee programs are implied as a guaranteed exchange for replacement products offered by LaserGifts. LaserGifts® does not offer cash refunds on any program returns.

 

Displays

Displays provided at no charge by LaserGifts® are offered as a courtesy for the exclusive use of LaserGifts® customers to display LaserGifts® products only, not to be combined with any other brands. These displays should not be modified or altered in any way. Upon discontinuation of ordering LaserGifts® products the customer must contact LaserGifts® for instructions for return.

 

Consumer Product Safety

LaserGifts® agrees to abide by current conformities required by the consumer product safety guidelines and regulations as stated in the Consumer Product Safety Commission standards if LaserGifts® has established such regulation applies to the product, as of manufacture date, to the product(s) offered by LaserGifts. LaserGifts® will provide its customers with the appropriate documentation necessary for items that fall within these guidelines upon request. LaserGifts® will not provide credit or allow for returns on product that the customer or the state or county in which the customer resides or conducts business has enforced regulations that may conflict with the current guidelines, any product that was not properly cycled on a FIFO basis and any future changes in standards as stated by the Consumer Product Safety Commission.
